Dear Chairwoman Galgiani,
Please oppose SB249 (Yee) as currently written. It will unreasonably create open ended financial liability for all special events at the Cow Palace forcing them to abandon this much loved State facility for other venues. This Bill will kill the Cow Palace. It will also cause job loss and financial hardship in the area as many of these shows will be unable to relocate within the region. A solution to the budgetary issues raised by Senator Yee on behalf of Daily City must be addressed on a Statewide basis. All major event venues serving the public and their communities, from concerts to art shows to Professional Sporting events, create the possibility for increased emergency services beyond what can be reasonably predicted. This bill asks that the event promoters at the Cow Palace bear 100% of the cost and liability for actions of the public that may or may not be the result of any negligence. A fight or other crime on a city street in conjunction with an event could be viewed as the responsibility of the promoters and cause them to pay for open ended costs normally – and correctly – borne by society. In the name of budgetary caution, Senator Yee is suggesting we should close down our cultural institutions rather than risk the cost of a fire or injury causing a local government to go over budget. This is a preposterous and draconian response to a complex issue that should be dealt with on a Statewide basis with consideration for the costs to all stake holders; the municipalities, the venues, the event promoters, the local communities, event attendees, and society at large.
